Context & Objective
Médecins Sans Frontières / Doctors Without Borders (MSF) invites qualified legal firms to submit proposals to form a panel of legal service providers. The selected firm(s) will provide legal counsel and support to MSFEA and affiliated MSF sections based in Nairobi, Kenya.
Scope of Services

Legal Advisory & Opinions: Rendering written legal opinions, advice, and memoranda on instructed operational matters.

Regulatory Compliance: Advising on NGO sector regulations, labor relations, employment law, skills development, tax, and finance matters.

Policy & Intersectional Legal Support: Collaborating with the MSF Intersectional Legal Department (ILD) on policy reviews, complex contract interpretations, and regulatory engagements.

Litigation & Dispute Resolution: Representing MSFEA in court litigation, statutory tribunals, alternative dispute resolution (ADR), and settlement negotiations.

Intellectual Property & Procurement: Providing guidance on IP protection, contract reviews, and procurement law compliance.

Failure to submit any of the following documents (or providing expired items) results in automatic disqualification:

Current CR12 Certificate (confirming partners/directors, issued within the last 6 months)

Valid Tax Compliance Certificate (TCC) and Copy of PIN Certificate

Current Practicing Certificates for all engaged advocates; lead advocates must be Advocates of the High Court of Kenya

Letter of Good Standing from the Law Society of Kenya (LSK)

Proof of Membership in a recognized legal professional body

Valid Professional Indemnity Insurance cover from a reputable insurer

Three (3) Signed Reference Letters from corporate or NGO clients

Signed Declaration of No Conflict of Interest

Signed Undertaking of compliance with MSF’s Code of Conduct, Safeguarding Policy, and Anti-Corruption/Sanctions Screening

Duly Signed Submission sent as a non-password-protected, zipped PDF prior to the deadline

Technical Evaluation (70% total weight): Requires a minimum threshold score of 50 points out of 70 to qualify for financial evaluation.
